LEGAL SIDE OF DIN APPLICATION
In accordance with sections 153 & 154 of the Companies Act, 2013, Director Identification Number (DIN) is a unique identification number allotted to an individual who is appointed as a director of a company, by making an application in form DIR-3. In case of a new company, an application for allotment of DIN should be made in eform SPICe at the time of incorporation of a company.
It is a unique director identification number allotted by the Central Government to any person who intends to become a Director or an existing director of any company.
DIR-3 Form: Any person who wants to become a director in a new Company is required to apply for the allotment of Director Identification Number (DIN) through SPICe eform at the time of incorporation of a company.
Any person who is a director in an existing company is required to make an application in eForm DIR-3 for allotment of DIN and must follow the prescribed procedure.
SUPPORTING DOCUMENTS
Attach the photograph and the scanned copy of all the supporting documents. i.e. identity proof and proof of residential addresss. It is not required to submit physical documents at the DIN cell. Along with the supporting documents, the verification by applicant to apply for allotment of Director Identification Number (DIN) is also required. It must contains the Name, Father's name, date of birth, address, signature of the applicant.
- Digital Signature
The eForm should be digitally signed and be uploaded on MCA portal.
- Fee Payment
After uploading of the form, the applicant is required to pay the fees for Form DIR-3. The applicant can do payment of the fees electronically is allowed (i.e. Netbanking / Credit Card / NEFT). No payment in the form of challan will be accepted under the procedure of DIN allotment.
The users are required to get themselves registered on the MCA21 Portal to obtain login credentials, afterwards, Login to the MCA21 portal and click on 'eForm upload' button for uploading the Form DIR- 3. Once the DIN application fee is paid, Form DIR-3 will be processed.
- Generation of DIN
After uploading of form and successful payment, In case Form DIR-3 details have not been found as potential duplicate, Approved DIN shall be generated and if the details have been found as potential duplicate, then Provisional DIN shall be generated.
- Processing of DIR-3 Form
In any case, Form DIR-3 is found to be potential duplicate, the DIN Cell of MCA will examine the e Form DIR-3 and the same shall be disposed within one or two days.
DIR-6 Form: It is a form for making changes in any particulars which are uploaded in DIR-3 Form. In the event of change of address of any director, then he/she is required to intimate the change by filing eform DIR-6 along with the requisite attested documents.
WHAT ARE THE COMMON CAUSES OF REJECTION OF DIN FORM?
- The Name must be expanded even if the ID proof of the applicant contains the name in abbreviated form.
- Using prefixes like Mr. / Ms. / Kumari / Shri etc. in the applicant's name
- Proof of residence i.e. Copy of Bank Statement, Electricity Bill, Telephone Bill, Utility bills etc. submitted are older than 2 months of submitting the application for verification OR if the documents are in the name of any other person.
- Any mismatch in the name of the applicant including spelling mistake may lead to rejection of application. Minor spelling deviations in the father's name may be accepted, if such deviations do not materially impact the name.
- If the seal or stamp does not contain membership/ practicing certificate number
Only such documents which are valid at the filing of form should be attached.
